UPDATE: Michigan SB 269 signed into law

Michigan Governor Rick Snyder signed SB 269 into law on May 22nd, 2012. This law raises the small claims limit in the state from $3,000 to $5,000. The small claims limit will continue to increase by $500 every three years until it reaches $7,000 in 2024. The original bill proposed to raise the small claims limit to $8,000 but was amended down in the process of passing in the Michigan House of Representatives. Click here to read Michigan SB 269.

 

Minnesota Raises Small Claims Limit

In August 2012, the Minnesota small claims court limit will increase from $7,500 to $10,000. This limit will give Minnesota the same limit as eight other states. In 2014, the limit will rise again to $15,000 making it the second highest small claims court limit in the country behind Tennessee, which has a limit of $25,000.

HALT Launches Study Showing States’ Secrecy Regarding Lawyer Ethical Transgressions

In today’s online information age, consumers can easily learn where a lawyer went to school, how long he or she has been in practice, whether or not the attorney is in good standing with the state bar and in some instances, what they typically charge for services. What the vast majority of Americans cannot easily discover, however, is whether the attorney they are considering hiring has a disciplinary record. Unless an attorney volunteers this information directly or a state bar or disciplinary office makes it available to the public, consumers are left in the dark. They have no way of knowing the number of complaints, the type of misconduct alleged, the number of investigations started, the number dismissed, and if misconduct is found, the type of severity of discipline imposed.

To galvanize states to reform their flawed systems for overseeing lawyers, HALT, the nation’s oldest legal consumer advocacy group, conducted a breakthrough national study identifying those attorney discipline systems that use transparent practices and those that operate under the most secretive procedures. The results of the study show that most states conceal critical information about ethics charges against lawyers, routinely ignoring consumers’ right to know about current and previous transgressions of an attorney they are considering hiring.

Michigan SB 269 Advances to House

A bill to raise Michigan's small claims limit from $3,000 to $10,000 (SB 269) was amended down to $8,000 before passing out of the Senate Judiciary Committee last year.  While HALT supported increasing Michigan's threshold to $10,000, we are now supporting the legislation as amended and have encouraged the House Judiciary Committee to enact SB 269 as amended.  A hearing on SB 269 is expected during March, 2012.
